We will need to publicize every Senator and Representative who takes part in this. So far it appears that they intend to pass whatever they want, no matter how loud the outcry has been from the people. We can only assume that they are being paid enormous amounts to totally disregard the wishes of the people who put them in office.

Fighting for Food Freedom
Who would have ever thought that we would actually have to fight for the right to have healthy natural food? Did you ever think that would be possible? I sure didn’t. We always took fresh natural food for granted. We always thought it would just be there. After all, its a part of nature, right? Farmers were always a part of our culture.
All of that is in danger.

One, just one, US Senator has stepped up to defend Food Freedom: Tom Coburn, MD, of Oklahoma, remains opposed to S.510 as, he says, “on principle”. According to his office, he will not provide “unanimous consent” to move the bill forward, even if the “Tester Amendment” is added.

If The Fake “Food Safety” Bills
Don’t Pass the Senate this Coming Week…
Food Freedom Has a Chance… If We Push Back More!

We spoke earlier today with staffers at Senator Coburn’s Washington office. They shared an interesting Estimate of Situation with us.
We also heard from a variety of farmer and rancher action groups garnering support for the amendment to S.510 offered by Senator Tester and others, that would protect a tiny portion of our local food production. While it would be nice to think that we could solve the problem with an amendment, Food Fascism will not go away that simply.
Sadly, the Natural Solutions Foundation cannot support the Tester Amendment which exempts local food resources in one state, or within 400 miles of the farm or ranch, if the farm’s gross annual sales are under a half million dollars. Our farmer and rancher contacts tell us there are hardly any local agricultural facilities still in business that meet that requirement. The proposed amendment is nothing more than trivial window-dressing and slippery DC deal-making as usual. We reject it and, as the First Amendment reminds us we have the right to do, we seek redress of grievances… we want the Food Freedom Amendment [ see below] protecting our local food resources from Federal interference.
There is good news from Dr. Coburn’s office. The Senator will refuse “unanimous consent” on S.510. The same may be expected regarding S.3767 (though his office was involved in getting S.3767 amended to limit its impact, as we reported yesterday when we told you about that partial, limited victory for freedom). He does not support any amendment to S.510 (including the Tester Amendment) since he opposes the bill in its entirety.
IF S.510 gets to the floor of the Senate for open debate, Dr. Coburn will consider sponsoring several amendments including our Food Freedom Amendment.
Now, General Bert tells us, is not the moment to let either our guard or our offense down. We intend to continue to push back next week to make sure neither S.510 nor S.3767 gets slipped through. General Bert believes that while the acute situational dangers may peak next week. Whether or not they do peak and then die down, they continue to be very real until the new Congress is seated in January.
Our Estimate of Situation strongly suggests that the current majority may believe they are poised for an historic loss of power and unless the Administration gets its bills through Congress now, it will get no significant additional government empowerment bills passed through Congress hereafter. Therefore, there will be continuing efforts to push these bills through, against the expressed desires of the public. The public must continue to express its desires yet more strongly, yet more loudly and yet more effectively.
Our Push Back is already creating a serious problem for the food fascism forces. They need more problems and we can give it to them!

The “serious” harm amendment (HEN10891) added by the Judiciary Committee on September 23, 2010 to S.3767 is not sufficient to protect food distributors from bureaucratic and criminal harassment. The “Tester Amendment”, if added to S.510, does very little to protect local food resources. We the People, need protection against over-zealous regulators who will destroy small producers while big companies can afford the legal talent needed to escape penalties. These bills will create “barriers against entry” to secure monopoly power for Big AgriBiz.
Our communities need to be protected by law from Federal Government interference in local and natural food production and distribution. We need a Food Freedom Amendment, such as we proposed last year when the House was considering its version of S.510 and which we have continued to urge; it should be offered and added to any “food safety” bill Congress considers!

“No provision of Federal Law giving regulatory oversight to any Federal department or agency shall be deemed to apply (a) to any home, home-business, homestead, home or community gardens, small farm, organic or natural agricultural activity, (b) to any family farm or ranch, or (c) to any natural or organic food product, including dietary supplements, as protected under the Dietary Supplement Health and Education Act of 1994.”
Food Freedom is part of Health Freedom, and an essential part of the Liberty that all free people have a right to expect. Legislators have a responsibility to protect that freedom from the bureaucracy they foist on us. Local oversight of local food production would be far superior to big govt poking into all our local activities. Reducing central govt power would enhance the overall health of our society.

Supplements in Danger Again
Congress Seeks to put Dietary Supplement Makers in Jail for Ten Years!

Pharmaceutical companies are once again interfering with your ability to access information about dietary supplements.
The Senate is debating a bill that will enable the FDA to put vitamin supplement makers in jail for ten years if they cite findings from peer-reviewed published scientific studies on the label of their dietary supplements or their web site.
The pretext for these draconian proposals is a bill titled the Food Safety Accountability Act (S. 3767). The ostensible purpose of the bill is to punish anyone who knowingly contaminates food for sale. Since there are already strong laws to punish anyone who commits this crime, this bill serves little purpose other than enriching pharmaceutical interests.
The sinister scheme behind this bill is to exploit the public’s concern about food safety. Drug companies want to convince your Senators that an overreaching law needs to be enacted to grant the FDA powers to define “food contamination” any way it chooses.
Even today, the FDA can proclaim a dietary supplement as “misbranded” even if the best science in the world is used to describe its biological effects in the body. The concern is that the FDA will use the term “misbranded” in the same way it defines “adulterated” in order to jail dietary supplement makers as if they were selling contaminated food.
The new bill being debated in the Senate increases the penalties the FDA can use to threaten supplement makers to ten years in prison. The big issue here is that the FDA will use this as a hammer to threaten and coerce small companies into signing crippling consent decrees that will deny consumers access to truthful non-misleading information about natural approaches to protect against age-related disease.
